USI-Tech Hit By Emergency Cease And Desist Order In The USA

USI-Tech Limited (USI) claims to be an online Forex and Bitcoin trading platform provider, located in Dubai, United Arab Emirates.
Co-founders of USI -Tech are Mike Kiefer, Ralf Gold and Horst Jicha.
Texas Securities Commissioner Travis J. Iles entered an Emergency Cease and Desist Order Dec. 20 against USI-Tech Limited, an overseas firm that is promising low-risk, triple-digit returns from investments tied to Bitcoin mining.
The enforcement staff of the State Securities Board presented evidence to the Securities Commissioner that USI-Tech, based in Dubai, and two U.S.-based sales agents are soliciting investors in dozens of Texas cities through targeted craigslist advertisements, YouTube videos, and standalone websites.
Neither USI-Tech nor the sales agents, Clifford Thomas of Suitland, Md., and Michael Rivera of Los Angeles, are registered to sell securities in Texas. The investment also is not registered in Texas.
The company and agents are offering for sale an investment contract in the mining of bitcoin. Mining uses significant amounts of computing power — and electricity consumption — to generate bitcoins for the decentralized online ledger that records and verifies bitcoin transactions.
The agents’ websites claim the mining investment “derives its value from [USI-Tech’s] non-exclusive interest in a series of Bitcoin mining contracts.” They promise a daily return of 1%.

Forever Living Warned By ASA

 
A Warwick-based health products distributor has been rapped by advertising regulators after complaints were made about claims on its website.
Forever Living Products (UK) Ltd, part of US-headquartered Forever Living, makes and sells a range of aloe vera-based products for the health market.
It has been warned about two claims on its website, foreverliving.com, by the Advertising Standards Authority (ASA) after a complaint was lodged by Northamptonshire Trading Standards.
The organisation challenged whether claims about the company’s Forever Therm supplement were authorised on the EU register and if claims made in an ad for clients’ weight loss were in compliance with advertising codes.
Forever Living argued that the product could contribute to a reduction of tiredness and fatigue, which is authorised on the EU register in relation to vitamins B6, B12 and C, and said the

Ackman Sends Warning To Herbalife’s New Compliance Chief

 
The NY Post reported earlier today:
Bill Ackman wants to give Herbalife’s new head of compliance, Pamela Jones Harbour, a few pointers.
The billionaire activist and Herbalife’s biggest critic on Thursday fired off a 19-page letter to Harbour — who has been on the job just a month — telling her that she has her work cut out for her.

“Based on our extensive investigation over the past three years, we believe Herbalife operates the largest and best-managed pyramid scheme in the world,” David Klafter, a lawyer for Ackman’s Pershing Square hedge fund, wrote in the letter first reported by Reuters.

Harbour is facing an “immense” challenge as the company’s business will likely collapse if she does her job and acts in the best interests of consumers, the letter warns.
“You may find yourself at the fulcrum of choosing between protecting consumers or protecting the company. Based on our research, we do not believe you can do both,” Klafter said.
Herbalife’s declining sales in the US over the past two quarters indicate that is already happening, Klafter suggested.
Since Herbalife stunned Wall Street on Monday with lower-than-expected earnings and dismal projections, the stock has fallen about 30 percent, closing at $39.99 on Thursday.
