Network Marketing in 2016 Back to Basics

Kevin Thompson, the MLM Attorney has published an other awesome article about Network Marketing:
“When Paul O’Neil delivered his first speech as CEO at Alcoa (the aluminum manufacturing giant), he shocked the audience of shareholders when he disclosed his top priority for his tenure as CEO.
Instead of doing the usual dance where the CEO talks about increasing sales, increasing margins and driving down costs, he talked about something that seemed completely unrelated to revenue.
His top priority: worker safety.
Worker safety!?  The shareholders were appalled.  After all, what does safety have to do with share value on the New York Stock Exchange?  Countless shareholders immediately dumped their shares, thinking that Alcoa hired an out-of-touch powder puff CEO…someone who lacked the guts to make tough decisions and focus on the bottom line.
The result?  During

Kevin Thompson – Lessons Learned From The FTC vs Vemma Law Suit

Kevin Thompson, the MLM attrorney, is part of the Vemma’s Legal team, in this write up he shares his knowlege. Stuff to read for corporate executives as for Network Marketing professionals in the USA and those entering the USA market.
This was very interesting to read:

In fact, our guess is that most companies will stand pat and continue to take one of two ignorant approaches. The first is the “that won’t happen to us” approach. The proverbial logic behind this approach goes something like this: the FTC doesn’t pursue many companies; with each passing day, more and more companies invade the industry’s space; therefore, our company won’t be THE COMPANY that serves as the government’s sacrificial lamb.

Kevin Thompson:
“This is Part Two of our series on the Vemma ruling. In Part One of

Vemma Might Be In Business After 3 September

According to Kevin Thompson – the MLM attorney, in below video, there is a fair chance Vemma will be again in business next week.
Kevin Thompson is the leading Network marketing top attorney in the USA.
He stated: “It’s my opinion that the FTC got this one wrong. Vemma, with a long history of product value and a A+ rating with the BBB (a near impossible feat), does not fit the “pyramid scheme” mold. This is an important case”.
He also stated that he believes the Injuction (a court order to stop business) will be lifted after the hearing, the first meeting in front of the judge, between Vemma and the FTC.
He also believes the lack of regulation in the MLM – Network marketing industry has triggered this lawsuit, basically the FTC can

The MLM Attorney: The Economics Of A MLM Law Suit

Kevin Thompson, the MLM attorney, has published an interesting article about Ligitation. Ligitation is a term for a law suit, action, or cause instituted or depending between two private persons in the courts of (USA) law.
Kevin Thompson:
The Economics of MLM Litigation
Thompson Burton’s MLM law practice often fields questions from companies looking to sue distributors for various reasons. We also take calls from distributors that are being sued by their former network marketing company.  We’ve seen the same issues litigated, over and over, from both sides, across the country. The surface reasons for these suits are usually the same: cross-recruiting.
Distributor Sam wants to sue Company XYZ because Sam was terminated after joining a new network-marketing venture.  Or Company XYZ sues Distributor Sam for recruiting XYZ distributors for disparaging the company and

The MLM Attorney – Deals Not Disclosed Is Fraud

Kevin Thompson, The MLM Attorney stated:
In December of 2014, I wrote an article titled “MLM Special Deals: The Fraud Ends Now.”  The article was about “Business Development Agreements” / confidential deals used by MLM companies to attract networkers.  The more success in prior companies, the sweeter the terms.  After reaching a deal, the networkers publicly announce, “After some serious due diligence and deep reflection, my heart has led me to join Company ABC….I find their products to be best in-class and their compensation plan to be the most rewarding I’ve ever seen.”
And since the private deals typically require aggressive volume goals, it naturally leads networkers to raid their prior organizations (or cut private deals of their own).
Two things: (1) It’s fraud.  It’s a material fact that, if known, affects the

Time to Reexamine DSA’s Code of Ethics: Suggestions From MLM Attorney, Kevin Thompson

It’s old news now. Avon left the DSA. In their announcement, they stated the DSA’s Code of Ethics needed revision. Specifically, Cheryl Heinonen at Avon said,

“We believe the association’s agenda in the U.S. is overly focused on the issues of a few specific brands rather than industry-wide challenges. . . We believe that the U.S. DSA Code of Ethics requires updating to better reflect the current state of the industry in the U.S.”

In a separate article in the Washington Post, Heinonen gave a quote that shed a little light on what she meant. She said,

“I think it’s problematic when you sell inventory — bulk product — that the person who is acquiring it can’t use themselves and sometimes may not know how to sell,” Heinonen said. She added that the language in the trade association’s code of ethics on this point and other aspects of consumer protection need to be firmer.”

The problem: inventory loading. And I’ll drill down a little deeper because inventory loading, when it exists, is a symptom of a larger problem: lack of product value. In other words, when there’s a lack of legitimate demand for product, companies incentivize participants to “load up” on items they might
