Bill Keep’s Open Letter To Warren Buffett On MLMs

Now that Pampered Chef, the multi-level marketing company owned by Berkshire Hathaway Inc., has a new CEO, MLM expert and dean of the College of New Jersey School of Business Bill Keep is hoping to get some support in setting clearer standards on what is or is not a pyramid scheme.
To do that, he’s published a letter that he sent to Warren Buffett earlier this year, with no response, possibly hoping to get the attention of the Pampered Chef CEO Tracy Britt Cool.

“I ask that you consider, as an owner of an MLM company, the value of having clear and public standards that differentiate a legal MLM from a pyramid scheme,” Bill Keep wrote in the letter, dated August 25, which he tweeted today. “Should you conclude that such standards are important to protect consumers and investors, I ask that you publicly address the issue.”

Bill Keep: No standard for what separates MLM and pyramid schemes
As Bill Keep and others have explained before, when you’re trying to figure out if a company is a legal MLM or apyramid scheme, the central question is whether their revenue comes from primarily from selling goods or from recruitment. But more sophisticated pyramid schemes also make some amount

Zeek Rewards CEO Pleads Not Guilty To Scam

A North Carolina man accused of being the mastermind of an $850 million Ponzi scheme pleaded not guilty Thursday to multiple federal charges of fraud and conspiracy.

Paul Burks, the founder and CEO of the ZeekRewards penny auction site, was arraigned before U.S. Magistrate Judge David Cayer at the federal courthouse in Charlotte. In late October, a grand jury indicted Burks on charges of wire, mail and tax fraud, and conspiracy.
Burks said nothing during his brief appearance in court. His plea was entered by his attorney, Noell Tin. If convicted on all of the charges he faces, Burks, 67, faced 65 years in prison and a $1 million fine. At the conclusion of the hearing, Judge Cayer released Burks on $25,000 bond. No trial date has yet been set. Burks company and its Zeekler.com auction site was shut down by the U.S. Securities and Exchange Commission in August 2012, after the agency concluded it had sold $850 million in unregistered securities.

Prosecutors say Burkes and his conspirators ripped off as many as 1 million investors with promises of big returns and what ultimately turned out to be bogus investments. Burks, who had been accused of pocketing as much as $10 million in investors’ money, agreed to

Herbalife Director Is Being Charged In Brazilian Embezzlement Case

A director of U.S. nutrition company Herbalife is among 12 people charged in a years-old Brazilian embezzlement case that has never been mentioned in Herbalife public disclosures, according to court documents and company filings.
Herbalife has become one of America’s most closely-watched companies after billionaire investors William Ackman and Carl Icahn squared off with enormous bets on its future, with Ackman betting on its demise and Icahn on its success.
Prosecutors in Brazil charged current Herbalife board member Pedro Cardoso with money laundering in 2008 for allegedly participating in an embezzlement scheme a decade earlier that siphoned 26.7 million Brazilian reais ($10.4 million) from the state government in Espirito Santo.
The 8th Criminal Court of Vitoria ordered bailiffs to serve him with a subpoena in 2010, but they did not locate him and the case remains open, according to court filings and a court source.
According to the U.S. Securities and Exchange Commission’s rules on disclosure, companies must report legal proceedings that are material to evaluating the integrity of a director. Herbalife has not made the information about Cardoso’s case public, according to proxy statements it has filed since 2009 when Cardoso joined the company’s board.

Cardoso said in a statement dated this week emailed to

Trévo CEO Donates To Nigerian Children’s Charity

As Trévo President and CEO, Mark Stevens, traveled to Nigeria last month he did much more than present the first ever “Create Your Explosive Team” training. Trévo donated one million Nigerian Naira, about $6,200 USD, to the SOS Children in Nigeria charity. SOS Children is a global charity that has been supporting children, families and their communities to flourish for over 60 years.
Despite Nigeria being oil-rich, hundreds of thousands live in crippling poverty. Crime and HIV/AIDS are on the increase. SOS Children in Nigeria helps vulnerable children stay with their families and where necessary, give them a loving home in one of their SOS Children’s Villages.
Around 15 million children are engaged in child labor, many in very dangerous conditions in Nigeria. Some children work in hazardous industries where they are potentially exposed to toxic fumes and dangerous machinery. About 360,000 children live with HIV/AIDS and this disease is a major cause of the increasing poverty in the country. The child mortality rate stands at 138 per 1,000 live births and around 30 percent of children under the age of five are underweight.
SOS Children is in 133 countries where they have provided long-term care for almost 62,000 children in 547 SOS
