Direct Selling Companies Hit by E-Commerce In India

Direct selling companies have taken a direct hit from ecommerce in India. Distributors of Amway, Oriflame and Tupperware in India are selling products online through Flipkart, Snapdeal, eBay and Amazon, disrupting the direct-sales business model.
Even about a year after issuing notices to online marketplaces to halt the sale of their products, direct selling firms have little control over such transactions. While Amway and Tupperware continue to resist the ecommerce onslaught, some others have taken to collaborating with the online marketplaces.
Hindustan Unilever has shut its direct-to-home model, HUL Network. Instead it has relaunched its Aviance beauty products and Ayush remedies on portals such as Amazon. Eureka Forbes, which sells water purifiers and vacuum cleaners, has launched specific models to sell on Flipkart and Snapdeal.
An HUL spokesperson said the company reviewed the business in 2014

Amway Continues To Make Changes In Their Indian Market

In May 2013, shock and a pall of gloom descended over the Indian operations of Amway, the direct selling firm whose portfolio includes shampoo and protein powder. Its expat managing director William Pinckney along with two other senior leaders were arrested and taken to jail on allegations of “cheating distributors and unethical circulation of money.”
This was followed by yet another round of arrests of Pinckney and a couple of others lasting over two weeks, the direct selling industry facing litigation, apprehensive employees and distributors looking for other employment options and the growth momentum winding down.
A few years later, a cricket match is on within the same office premises, with the man in the corner room, Anshu Budhraja, donning the wicketkeeper gloves and urging employees to give the tournament — Amway Premier League

Amway Looks To Work With Authorities After Recovering From Arrest of A CEO

Direct seller  Amway India is looking to put behind it controversies stemming from the arrest of its top leadership over allegations related to various irregularities and regain growth momentum while charting out a new phase of engagement with the government.
Anshu Budhraja, the Rs 1,900-crore direct selling firm’s first India head in 16 years, said his immediate priority is to engage with the government constructively and take Amway forward from what he said is a “point of inflexion for the next growth phase.”

Amway has consistently denied any wrongdoing on its part. “An Indian leader understands the sensitivities of Indian culture,” Budhraja said in an interview. “He has the benefit of growing up and being part of system. It’s very simple… the way an Indian will interact with key stakeholders will be different from what a

Amway India In Trouble Again For Questionable Laws

Two social workers moved the Nagpur bench of Bombay High Court against Amway Company accusing it of selling many products without approval from Food Safety and Standard Authority. Sachin Khobragade and Jammu Anand claimed in their PIL (No. 69/2014) that the company got approval to sell only four products, but it was selling 36 products, flouting the norms.
A division bench comprising justices Bhushan Gavai and Vinay Deshpande then issued notices to Food Safety and Standard Authority through its chief executive officer, union health secretary, food safety commissioner and Amway India Enterprises Limited, asking them to reply within three weeks.
The petitioners stated that nutrilite products sold by the company didn’t comply with strict quality and quantity norms and labels used on its boxes were misleading. They had apprised of the Food and Drugs Administration (FDA) commissioner many a times but no action was taken. They demanded investigations into all its products from the Food Safety and Standard Authority.

Amway India’s CEO Released From Jail After 2 Months

Direct-selling company Amway India on Monday said its MD and CEO William S Pinckney has been released on bail, two months after his arrest by Andhra Pradesh Police in connection with criminal cases registered against the firm in the state.
A spokesperson of Amway said Pinckney has been granted bail in all the cases in Andhra Pradesh.
Commenting on the development in a joint statement, Amway chairman Steve Van Andel and president Doug DeVos said: “The release of Amway India CEO Bill Pinckney is a great relief.”
They, however, added they were “profoundly dismayed that this unnecessary detention occurred at all, and are even more troubled that it lasted so long”.
Amway regional president, Europe, South Africa & India Samir Behl said: “His arrest and long detention was unnecessary and unreasonable. We will vigorously defend ourselves at trial.”
Pinckney was arrested on May 26 from Amway India’s headquarters at Gurgaon and later was produced before a court in district Kurnool, which sent him to judicial custody after rejecting his bail plea.
He was subsequently arrested in other criminal cases registered against him in the state on allegations of financial irregularities by Amway, a charge contested by the company.
“Our focus is squarely on efforts to ensure that

Amway India Makes Very Little Legal Progress

Justice Nooty Ramamohana Rao of the Hyderabad High Court on Tuesday granted permission to Amway India Ltd to operate 50 per cent of the amount from its bank accounts in the state.
While admitting a writ petition filed by the company questioning an order of the superintendent of police, Kurnool, directing seizure of all bank accounts of the company, the judge granted the interim relief. The company contended that since the investigation against the company was handed over to the CB-CID, the superintendent of police had no power to issue the proceedings to seize its bank accounts.
CEO Willam S. Pinckney has still not been released from jail. No word on when that might happen.
“The CEO has been booked under the Prize Chits and Money Circulation Schemes (Banning) Act besides charges of cheating as well as extortion under relevant sections of the Indian Penal Code (IPC),” the police officer said.
This is the second time that Pinckney has been taken into custody, after the Kerala police arrested him as well as two Amway directors earlier, for alleged financial irregularities. Condemning the arrest of Pinckney, Ficci said the “uncalled” for action may hit Indo-US business ..

Amway Urges India To Release Bill Pinckney

Amway India’s CEO Bill Pinckney was arrested on May 26 at Amway’s headquarters in Gurgaon. At the time of this writing, he remains in police custody. This continued detention and harassment must end. Amway is a reputable company with 55 years of operating legally and ethically in more than 100 countries and territories worldwide.
And while the newly elected Union government in New Delhi played no role in this police action, we ask their help with the immediate release of Bill so he can be quickly and safely return to his family. To continue with this investigative retention when we have fully cooperated with all investigations and requests from authorities in India – including Andhra Pradesh – is unnecessary and unreasonable.
Whenever our business model has been questioned, we have shown up to provide answers. We have made every effort to be entirely transparent and forthcoming with authorities. If there is a problem, we want to fix it so we can continue to do business in India.
The underlying issue at hand is the lack of clear direct selling regulations that distinguish legitimate businesses like Amway from dishonest ones.
Additionally, provisions of the Prize Chits and Money Circulation Schemes (Banning) Act seem to be
