FTC Press Release: Vemma Agrees To Ban On Pyramid Scheme Practices To Settle FTC Charges

 
Under a settlement with the Federal Trade Commission, Arizona-based Vemma Nutrition Company will end the business practices that the FTC alleged created a pyramid scheme.
The multi-level marketing (MLM) company, which sells health and wellness drinks through a network of distributors called “affiliates,” will be prohibited under a federal court order from paying an affiliate unless a majority of that affiliate’s revenue comes from sales to real customers rather than other distributors. The order also bars Vemma from making deceptive income claims and unsubstantiated health claims.
“Unfortunately, extravagant income claims and compensation plans that reward recruiting over sales continue to plague the MLM industry,” said Jessica Rich, Director of the FTC’s Bureau of Consumer Protection.

Breaking News: Vemma Vs. FTC – Pyramid Case Settled

 
In August 2015 the Federal Trade Commission (FTC) – an USA Government institution – hit Vemma with full power, many agents entered the head office in Phoenix, Arizona on a monday morning. A raid.
Bank accounts and credit cards were seized, 150+ employees were fired within a couple of hours, and a receiver took over.
A $180 million company was ruined, Vemma’s world wide distribution channel burned to the ground.
It was a direct attack on the MLM – network marketing industry.
The allegations: illegal pyramid scheme, income claims, failure to disclose, means and instrumentalities, relief defendent.
The FTC was granted a court order, to freeze the company’s and CEO B.K. Boreyko’s assets, as well as a temporary restraining order.

Vemma Reaches Settlement Agreement With The FTC

 
Vemma, as top distributors Tom and Bethany Alkazin have reached a settlement with the FTC in the case the agency filed more than a year ago.
While details of the settlement have not yet been disclosed, court documents state that the company and its CEO BK Boreyko as top distributors Tom and Bethany Alkazin have agreed to a permanent injunction and monetary judgement.
As legal costs mounted to well over $1 million, Vemma and Boreyko had an additional court battle with their insurance company Hanover.
In April, Hanover Insurance filed a complaint against Vemma and Boreyko seeking a court declaration that it was not required to pay the legal costs because, the insurer contended, it was not properly notified about previous allegations that arose years earlier.

Xango Pops Up On The FTC Radar

 
The FTC is a USA government organization, their mission:
“To prevent business practices that are anticompetitive or deceptive or unfair to consumers; to enhance informed consumer choice and public understanding of the competitive process; and to accomplish this without unduly burdening legitimate business activity.”
One of the results of the FTC battle against Vemma, is their case against Tom Alkazin, Vemma’s nr. 1 top earner.
In the latest filing from the FTC vs. Tom Alkazin, Utah based direct Selling Company Xango pops up.
Xango, founded in 2002 is a B classified company by Business For Home.
A number of Vemma top leaders joined Xango in October – November 2015 and the company introduced a initiative simular to the YPR (Young People Revolution) program of Vemma. That program was one of the triggers of the FTC case

The USA Direct Selling Association (DSA) describes its role as “the national trade association for companies that offer entrepreneurial opportunities to independent sellers to market and sell products and services, typically outside of a fixed retail establishment”.

Vemma Sales Up 65%

 
Vemma has filed his quarterly report to the USA court.
The two big takeaways from this report is that sales since November are up 65% and Vemma would be profitable if it wasn’t for the debt the receiver created for the company.
I have a lot of respect for BK Boreyko, Vemma’s CEO. It is a General who lost 95% of his resources, revenue and troops, is under heavy fire, refuses to surrender and makes progress. “Never quit” is often a slogan in Network Marketing, BK Boreyko deserves the “Never quit” award

USA – FTC vs Network Marketing Industry: Defense Fund Formed
