Amway India In Trouble Again For Questionable Laws

 
Two social workers moved the Nagpur bench of Bombay High Court against Amway Company accusing it of selling many products without approval from Food Safety and Standard Authority. Sachin Khobragade and Jammu Anand claimed in their PIL (No. 69/2014) that the company got approval to sell only four products, but it was selling 36 products, flouting the norms.
A division bench comprising justices Bhushan Gavai and Vinay Deshpande then issued notices to Food Safety and Standard Authority through its chief executive officer, union health secretary, food safety commissioner and Amway India Enterprises Limited, asking them to reply within three weeks.
The petitioners stated that nutrilite products sold by the company didn’t comply with strict quality and quantity norms and labels used on its boxes were misleading. They had apprised of the Food and Drugs Administration (FDA) commissioner many a times but no action was taken. They demanded investigations into all its products from the Food Safety and Standard Authority.

“Pyramid Scheme Or Not, Herbalife Is Tanking”

 
The LA Times released the following article today, making a bold prediction about industry giant, Herbalife:
In  December 2012, Hedge fund investor Bill Ackman painted a huge bull’s-eye on the back of Herbalife, labeling the Los Angeles nutritional supplements company an illegal pyramid scheme and placing a $1-billion short bet against its shares.
Ackman supported his bet with a 334-slide PowerPoint presentation that eviscerated the company in heroic detail. Whether Herbalife’s business model is illegal — ongoing investigations by federal and state authorities have that issue, and others, under scrutiny — much of what Ackman said at the time appears well-taken today.
So far this year, Herbalife’s shares are down about 43% — including a roughly 20% drop Tuesday (as of this writing) after the company shocked investors with a bad quarterly report and a pessimistic view of the future Monday. Its shares are currently trading below $45. Ackman, whose short bet is thought to have been made at about $50 a share, appears to be back in the black, after having faced a hefty loss when the stock reached the low $80s earlier this year.

Nu Skin Q3 Revenue Down 30% To $638 Million

 
Nu Skin Enterprises, Inc. (NYSE: NUS) today announced third-quarter results with revenue of $638.8 million, the top end of the company’s prior guidance and a 30 percent decline from the prior-year period.
Comparable revenue in the third quarter of 2013 included $203 million in sales from the company’s limited-time introduction of its ageLOC® TR90® weight management system.
Revenue for the third quarter of 2014 was negatively impacted three percent by foreign currency fluctuations. Earnings per share for the quarter were $1.12, ahead of expectations, versus $1.80 in the prior-year period.
 

“We made significant progress during the third quarter,” said Truman Hunt, president and chief executive officer.

“We believe our business in China is stabilizing as we are seeing improving trends in the early sales leader pipeline, we strengthened our capital structure and balance sheet flexibility, we are making good progress in our product development efforts, and we generated positive operating cash flow.

We have also seen continued enthusiasm among our sales force at recent sales leader conventions in our South Asia/Pacific, Greater China and Americas regions.

Avon Products’ Rating Cut To Junk By S&P

 
Standard & Poor’s Ratings Services on Monday cut beauty products direct seller Avon Products Inc. corporate rating to junk, citing the company’s slower-than-expected progress to improve business and weak results, particularly in the U.S. and Brazil.

“Some of the company’s issues are deeper than we anticipated,” S&P said, cutting Avon’s corporate rating to double-B-plus, one notch below investment grade. While the company has a good geographic diversity, the rating agency said, “it will take time to re-engage its active representatives and rebuild sales growth.”

S&P, however, kept the company’s outlook at stable, signaling an expected improvement.
Founded in 1886 by David H. McConnell, a traveling book salesman, Avon became known for a growing sales force of women—the Avon Ladies—and its trademark “Avon calling!” But the New York-based company has been struggling to grow sales and attract and retain sales representatives.
Avon, which in July reported another quarter of disappointing sales and lower profits but said its U.K. market had reported the first quarter of sales growth since 2010, is the midst of a multiyear restructuring plan that the company is hoping will result in $400 million in savings.
