TriVita Loses Trademark After FTC Fines Them $3.5 Million

 
A year after the Federal Trade Commission fined supplement maker TriVita Inc. $3.5 million for making unsupported health claims about its Nopalea cactus juice drink, a federal appeals court on Friday also refused to give the company a trademark registration on the juice name. 

The Federal Circuit ruled that “Nopalea” couldn’t be registered as a trademark because it is merely descriptive of the drink — made from juice of the nopal cactus — that TriVita was selling with it.
Although TriVita argued that the addition of the letters “ea” at the end of “nopal” made the name “substantially different in sight and sound” from the common juice name, the court reminded the company that “Nopalea” is the full name of the plant that produces nopal juice.
“’Nopalea’ is not a made-up word obtained by adding arbitrary letters,”

Indian Direct Selling Association (IDSA) announces its new Executive Committee at the General Body Meeting held in New Delhi. Mr. Rajat Banerji, National Head Corporate Affairs, Amway India Enterprises has taken over as the New Chairman of the Association from Mr. Ajay Khanna, Country Manager, Herbalife International India Pvt. Ltd.

Hindustan Unilever Network Launches E-Commerce for Direct Sales

 
India’s Hindustan Unilever (HUL) has changed the operating model of its direct-selling business, Hindustan Unilever Network, paving the way for a likely debut in e-commerce.
“The Hindustan Unilever Network business model has transitioned from physical servicing to an online ordering and fulfillment model,” an HUL spokesperson said.
Consumers can buy the Aviance and Lever Ayush range of health and beauty products through HUL network consultants, who will operate only online now and will no longer have any physical offices. HUL did not provide additional details.
The maker of Dove soap and Surf detergent, which launched the direct-selling division in 2003 to offer high-value home and beauty-care products, attributed the change in model to “optimising operating costs and making the business more competitive.”
